This Release of Liability Waiver (the "Waiver") is effective Sunday, August 25, 2024,

BETWEEN:

The Choctaw Nation, Choctaw Casino & Resort, (including, but not limited to, its officers, directors and employees) and any Volunteers a company organized and existing under the laws of the Choctaw Nation with its address located at 4216 US-69, Durant, OK 74701 and The Center for Tribal Transportation, (the “Releasors"), a company organized and existing under the laws of the State of Arizona with its address located at 1838 Commerce Drive, Ste. B, Lakeside, AZ 85929.

           

AND: the "Releasee” registering electronically on the Eventzilla ticketing platform to participate in the 2024 NTICC Heavy Equipment Roadeo, agrees to the following terms and conditions;

1. LIABILITY EVENT

1.1 Under the terms of this Release of Liability Waiver, which is hereby acknowledged, the Releasor hereby releases and forever discharges the Releasee of: The 2024 NTICC Heavy Equipment Roadeo - MINI EXCAVATOR I MOTOR GRADER I LOADER ("Liability").

1.2 Under the terms of this Waiver, the Releasor hereby releases and forever discharges the Releasee, including their agents, employees, successors and assigns, and their respective heirs, personal representatives, affiliates, successors and assigns, and any and all persons, firms or corporations liable or who might be claimed to be liable, whether or not herein named, none of whom admit any liability to the undersigned, but all expressly deny liability for any and all claims, demands, damages, actions, causes of action or suits of any kind or nature whatsoever, which now or may hereafter arise out of or in any way relate to any and all injuries and damages of any and every kind, to both person and property, and also any and all injuries and damages that may develop in the future, as a result of or in any way relating to the Liability.

2.COMPENSATION

2.1 The Releasor will not provide any compensation to the Releasee should a risk or hazard arise

3. BINDING EFFECT

3.1 It is understood and agreed that this Waiver is made and received in full and complete settlement and satisfaction of the causes of action, claims and demands mentioned herein, that this Waiver contains the entire agreement between the Releasor and the Releasee, and that the terms of this Waiver are contractual and not merely a recital.

3.2 This Waiver shall be binding upon the undersigned, and his respective heirs, executors, administrators, personal representatives, successors, and assigns.

 

4. GOVERNING LAW

This Waiver shall be construed and enforced in accordance with the laws of Arizona and/or the Laws of the Choctaw Nation.
